Comparação entre os modelos de execução penal da Associação de Proteção e Assistência aos Condenados (APAC) de São João Del-Rei e da Unidadede Progressão de Ponta Prossa (UPPG)

Abstract

In 2023, the Brazilian Federal Supreme Court recognized the massive violation of rights and the unconstitutional state of affairs in the Brazilian prison system. Considering the lack of available data and the lack of empirical research in the legal field on innovative and efficient methodologies on penal execution, the general objective was to carry out a critical and comparative analysis of the methods used at the Association for the Protection and Assistance of Convicts, in São João del-Rei, Minas Gerais, Brazil; and at the Progression Unit in Ponta Grossa, Paraná, Brazil. With the theoretical-methodological path, under the translational perspective, we identified that both methods emphasize family life, leisure time and incentives to work; help for victims; and the promotion of restorative justice; the monthly cost per prisoner is reduced in these institutions; the methods of penal execution studied move towards respect for human dignity, constituting viable alternatives to adapt the prison system and facilities to the provisions of Brazilian and international documents.
