Abstract

Based on the increasing rate of violence against women in the home and family environment, this research aims to provide a voice to those who appear to be victims of this violence - one of the most severe expressions of human rights violations. Therefore, it is based on the reflections provided by Feminist Epistemologies and Southern Epistemologies, passing by classical authors of Social Sciences (such as Max Weber and Karl Marx), to contemporaries (Pierre Bourdieu, Simone de Beauvoir, Boaventura de Sousa Santos, Herrera Flores, among others). In a field research conducted at the Court of Domestic and Family Violence against Women in Ponta Grossa/PR, the objective was to analyze the implications of family order resulting from the rejection of urgent protective measures to women with judicialized violence in 2017 - year of greatest number of cases since the implementation of said Court. Based on the documentary study of electronic processes that involve requests for urgent protective measures; in the production of statistical data; and in the execution of semi-structured interviews that supported the case study, the research allowed to identify the movement of Feminist Epistemologies and Southern Epistemologies in the processes, either in the discourse and decisions of the legal operators or in the women's life histories. Both show that the subordinate condition of women remains today and is reproduced in chauvinistic, exclusionary and violating behaviors resulting from the historically imposed patriarchal and heteronormative culture, specifically in Brazil. Realizing that institutions are not immune to these socio-historical and cultural elements, the research shows that the criminalization of domestic and family violence against women has been insufficient to positively alter the scenario, increasingly demanding the preparation of those who operate them, especially given the multiple determinants and implications of violence on women's lives. In this sense, the importance of the Network Against Violence against Women (integrated by the Judiciary) is emphasized, as well as the humanized and technically supported assistance to those who are victims. In addition to these conditions, essential for the effectiveness of the National Judicial Public Policy, other elements emerge and are highlighted as allies in the construction of practices that are more consistent with reality and its confrontation: the Culture of Peace and Human Rights Education.
