Judicialização de medicamentos no SUS: estudo comparativo antes e durante a pandemia da COVID-19

Abstract

The objective of this thesis was to compare the characteristics of drug requests via the public health court in the municipality of Ponta Grossa, before and during the COVID-19 pandemic. For this purpose, quantitative and qualitative research, systematic literature review, bibliometric analysis, documentary research and statistical analysis were used. The research considered the city of Ponta Grossa, Paraná as the municipality of study and the years 2018 to 2021 inherent to the actions for the supply of medicines as a time lapse. In presenting the results, the Multipaper format or Scandinavian model was adopted, which is characterized by the presentation of the study through a collection of articles. Thus, the developments of the articles are complementary to the understanding of the research problem. Throughout this process, five articles were developed. The first two are characterized by analyzing the main approaches of national and international scientific works, also conducting a bibliometric analysis. In the sequence of articles, it initially deals with Fundamental Rights, and addresses the main actors in the context in question, namely: judicialization, SUS, prescribers and users. Subsequently, it describes the profile of lawsuits with a request for the supply of medicines in the municipality of study and the final part, with a comparative study. Therefore, it is necessary to envision the circumstances of the judicialization of medicines, from a holistic perspective, to this end, we suggest comprehensive empirical studies with the mapping of legal demands at the local/regional level, as well as the reasons that lead users to call the judiciary, still, the readjustment of public health policies, expansion of access to justice, the strengthening of primary health care, with a focus on prevention.
