Adolescentes em conflito com a lei e a política de socioeducação: análise da execução das medidas socioeducativas em meio aberto no município de Guarapuava/Pr

Abstract

The present research was developed in the the Master's Degree Program in Applied Social Sciences at the Universidade Estadual de Ponta Grossa (UEPG), with the objective of analyzing the execution of socio-educational measures in an open environment in the city of Guarapuava/PR. With this in mind, through the Case Study, an incursion into the research field was carried out for an approximation to the reality experienced by professionals who work directly in the planning, execution and monitoring of socio-educational measures. During this journey, documents, data on infractions and the respective measures imposed by the Judiciary were analyzed. In that regard, semi-structured interviews were carried out with the technical team and social advisors. The analysis of the research data was carried out in the light of the theoretical basis of critical criminology, in order to understand the infraction as a social phenomenon, product of a political and economic model. In the introduction of the work presents the purposes of the study and the research methodology; In chapter 2, a documental analysis was carried out on the differentiated treatment of the Brazilian State in relation to the adolescent who committed an infraction, from the first Constitution of the Empire of Brazil in 1824 to the structuring of a Socio-educational System proposed by Law nº 12.594/2012, showing how the political, economic and social conjuncture influenced the direction of the State response to this question; In chapter 3, the analysis of the infractions committed by adolescents who live in Guarapuava on the period from 2011 to 2019 was carried out, which were obtained from the database of the electronic process system (Projudi) of the Vara da Infância e Juventude of the District of Guarapuava/PR , as well as the sociodemographic data of the city of Gurarapuava/PR, in comparison with the State of Paraná and Brazil. In chapter 4, we sought to understand the challenges and difficulties experienced by the team of professionals who work with adolescents in compliance with the socioeducational measure in an open environment. From the analysis carried out, it is concluded that the socio-educational measures, over the years, were used as an instrument of social control of adolescents in situations of vulnerability, marked by the process of institutionalization and criminalization of poverty; that the socio-educational system, as well as the penal system, reproduces the selectivity and stigmatization of its public; and that the application of socio-educational measures, as they are being carried out, are not enough to break the cycle of deprivation and violations of rights previously experienced by adolescents in situations of conflict with the law.
