Abstract

In the present dissertation he will be boarded the functions attributed to the punishment, they are the retribution and preventions, or of sustentation in the way of capitalist production, it occurs that such proposals are not adjusted to the proliferation of prisions models, where does not allow the communication of the convict. Moreover, it will be argued if in the panorama of a Democratic State of Right it exist space for this species of punishment. The objective in the dissertation are: to analyze the use political of the punishment since a historical point of view; to argue the democratic pretension of modernity and to critically analyze the function of the punishment in the societies of Interactive Modernity.
