Um olhar epistemológico sobre a Justiça Restaurativa à luz dos Direitos Humanos e o estado do conhecimento em programas de pós-graduação no Brasil, entre os anos de 2014 a 2016

Abstract

Restorative Justice is a concept under construction, because its practices are derived from experience. Thus, in this dissertation an epistemological look was made for this reality in the light of Human Rights, having as theoretical background the Epistemologies of the South. The methodological procedures adopted were the bibliographic and documentary research, with later study of the state of knowledge, tracing a epistemological profile of the theses and dissertations of Graduate Programs in Brazil, between the years 2014 and 2016. It was an exploratory work, organized in a quanti-qualitative perspective. The results pointed out that the Brazilian studies on Restorative Justice are mostly theoretical, with the most epistemological authors being cited: Foucault, Santos, Habermas, Bauman, Bourdieu and Durkheim, in that order. However, it has been found that researchers do not associate themselves in depth, nor exclusively with a specific epistemological current. The surveys take place throughout the country, proving to be a topic of interest to all regions, and there is an ascendancy in the number of works year after year. As a conclusion, we point out that the search for alternative forms of conflict solutions has motivated scholars from several areas to focus on Restorative Justice, but without a deepening of epistemology, that can understand it more as a promising paradigm than as a method of conflict resolution.
