Os desafios e as potencialidades das práticas restaurativas desenvolvidas nos Centros Judiciários de Solução de Conflitos e Cidadania do Paraná

Abstract

The objective of this research was to analyze existing restorative practices in the Judicial Centers for Conflict Resolution and Citizenship (CEJUSCs) of the State Justice of Paraná, especially how they are developed, the demands met and the perception of the subjects responsible for implementation. The adopted methodology has a qualitative character and is characterized as exploratory-descriptive. The methodological procedures employed were bibliographical, documentary and empirical research, divided into two stages, the first aimed at mapping existing experiences in the state CEJUSCs of Paraná, and the second aimed at identifying the difficulties and potentialities inherent in the process of implementing and expanding the restorative practices. The empirical research used questionnaires and semi-structured interviews. First, the questionnaires were sent to the 132 (one hundred and thirty-two) CEJUSCs in the State, obtaining 76 responses. From the analysis of the answers, the interviewees were selected, according to their experience with the theme and willingness. The interviews were transcribed and subsequently submitted to the content analysis process proposed by Laurence Bardin, which made it possible to critically interpret the participants' discourse and reveal the difficulties and potentialities of applying Restorative Justice. It was possible to conclude that Restorative Justice applies to the most diverse contexts, that despite the role of the State of Paraná and the significant amount of installed CEJUSCS, few counties develop restorative practices. The main challenges identified were the reduced team and the resistance of the participants, largely due to lack of knowledge. As for the potentialities, the humanization of justice, empowerment, democratic participation and active accountability were identified. At the end of the work, the indications that can contribute to the advancement of restorative practices in the CEJUSCs of the State Court of Paraná were scored: the remuneration of facilitators, community engagement, ongoing training of facilitators, dissemination and dissemination of information.
