As contribuições da justiça restaurativa na execução das medidas socioeducativas de privação e restrição de liberdade no município de Ponta Grossa - PR

Abstract

This research deals with the themes of socioeducation and Restorative Justice. Focused on the application of Restorative Justice in the execution of the socioeducational measure of deprivation and restriction of freedom. It seeks to answer the question: how has the Restorative Justice been received and incorporated by the public policy of Socioeducation in the municipality of Ponta Grossa, based on the SINASE Law, in the scope of the execution of socio-educational measures of deprivation and restriction of freedom? Its general objective is to analyze if the Restorative Justice has contributed to the development of the public policy of socioeducation, based on the SINASE Law, within the scope of the socio-educational measures of deprivation and restriction of freedom, in the city of Ponta Grossa-PR. The methodology used is qualitative in nature. The research is characterized as a case study. It is composed of the exploratory, bibliographic, documentary and field phases. The following data collection and analysis instruments are used: documentary analysis, participant observation, semi-structured interview and data analysis by category. During the course of the project, the following categories will be addressed: Adolescence, State, Public Policies, Socioeducation and Restorative Justice, the last two focused not only in Brazil, but also in Paraná and Ponta Grossa. One month of participant observation was carried out at the sites that comprise the research, being the Socioeducation Center, the Semiliberdade House and the Judicial Center for Conflict and Citizenship Resolution. Interviews were carried out with seven subjects who formed the sample. The results obtained showed that the Restorative Justice is being approved by the public policy of socio-education, both at the legal-formal level and in its care practices. In the context of the execution of the socio-educational measures of deprivation and restriction of liberty in Ponta Grossa, JR was portrayed as a tool that is contributing to the achievement of the goals of the public policy of socioeducation, but more investment in physical structure, human resources and in the training of facilitators within the socio-educational system. This research seeks to contribute to the academic debate about the necessary improvement of the public policy of socio-education in Brazil, starting from an approximate analysis of this with the Restorative Justice model.
