dc.description.abstractIn this thesis, I embarked on an interdisciplinary journey to reexamine restorative justice in Brazil, extending beyond the legal field to explore connections between memory, trauma, radicality, and the dynamics between the state and civil society. My research question was: "How can the institutionalization of restorative justice in Brazil be directed to amplify its transformative potential by integrating local knowledge and cultural practices to address and repair collective traumas, thereby challenging structural violence and contributing to the construction of restaurotopias?" The main goal was to understand how restorative justice could be reimagined in the contemporary Brazilian context, drawing from relational, social, and cultural experiences and considering the varied and deep narratives of those living in this territory, inspired by the concept of "intellectual ingestion" proposed by the Anthropophagic Movement. I argue that reclaiming the radical, transformative nature of restorative justice and integrating it with local practices and knowledge can aid in developing a more nationally aligned institutionalized justice system. This is because institutionalization depends not only on the revival of radicality and its integration with local knowledge and practices but also on the power dynamics and force correlations among various actors seeking this revival and the subjects of public institutionalization. Inspired by Oswald de Andrade's Anthropophagic Movement and using embodied writing, this thesis proposed a sensory immersion into the complexities and nuances of Brazil's history of pain and violence, and restorative justice, seeking deep reflection on memory, violence, and trauma. Through qualitative-exploratory methodology, examining literature, documents, and legislation, I analyzed legal documents, primarily CNJ Resolution 225/2016, and some examples of restorative practices in Colombia, Guatemala, and Brazil, to understand the challenges and potentialities of implementing anthropophagic restorative justice in Brazilian territory. The selection of examples was based on an analysis of the theoretical and practical production of restorative justice, approached critically and recognizing structural violence, including its interaction with the cultural and social environments of the involved parties. I concluded that restorative justice has the potential to repair historical wounds and transform society, valuing the country's cultural and social uniqueness, provided its implementation and execution are well-coordinated with the community and the individuals involved. Therefore, this research not only provided a retrospective and prospective overview of restorative justice in Brazil but also highlighted developments in the expanded approach to restorative justice and actions to support its critical and coherent institutionalization and implementation, so that in the medium and long term, we can construct other places, namely, restaurotopias.pt_BR
dc.description.resumoNesta tese, empreendi uma jornada interdisciplinar para reexaminar a justiça restaurativa no Brasil, indo além do campo jurídico para tecer conexões entre a memória, o trauma, a radicalidade e a dinâmica entre o Estado e a sociedade civil, para investigar a seguinte questão de pesquisa: De que maneira a institucionalização da justiça restaurativa no Brasil pode ser direcionada para amplificar seu potencial transformador, integrando saberes locais e práticas culturais para enfrentar e reparar traumas coletivos, desafiando assim as violências estruturais e contribuindo para a construção de restaurotopias?. O objetivo geral foi compreender como a justiça restaurativa pode ser reimaginada no contexto brasileiro contemporâneo, a partir de experiências relacionais, sociais e culturais, considerando as diversas e profundas narrativas dos sujeitos que habitam neste território, a partir da noção de deglutição intelectual, proposta pelo Movimento Antropofágico. Defendo a tese de que resgatar a radicalidade do caráter transformador da justiça restaurativa e integrá-la com as práticas e saberes locais pode auxiliar no desenvolvimento de um sistema de justiça institucionalizado mais alinhado às necessidades e peculiaridades nacionais. Isso porque a institucionalização depende de outros fatores além do movimento de resgate da radicalidade e de sua integração com práticas e saberes locais, dependendo, também, do jogo de poder e da correlação de forças entre os diferentes atores que buscam esse resgate e os sujeitos da institucionalidade pública. Inspirada no Movimento Antropofágico de Oswald de Andrade e utilizando a escrita incorporada, esta tese propôs uma imersão sensorial nas complexidades e nuances da história de dores e violências do Brasil, da justiça restaurativa, em busca de uma reflexão profunda sobre memória, violência e trauma. Por meio de metodologia qualitativa-exploratória, na literatura, documentos e legislação, analisei documentos legais, principalmente a Res. 225/2016 do CNJ, e alguns exemplos de práticas restaurativas na Colômbia, Guatemala e Brasil, para compreender os desafios e potencialidades de implementação de uma justiça restaurativa antropofágica no território brasileiro. As escolhas dos exemplos se deram a partir da análise de produção teórica e prática da justiça restaurativa, que atuaram sob a perspectiva crítica e de reconhecimento das violências estruturais, incluindo a articulação com o meio cultural e social dos envolvidos. Concluí, com a análise dos objetivos e achados da pesquisa, que a justiça restaurativa tem potencial capacidade de atuar na reparação de feridas históricas e na transformação social, valorizando as singularidades culturais e sociais do país, desde que articulada sua implementação e execução com a comunidade e com as pessoas envolvidas. Esta pesquisa, portanto, não apenas traçou um panorama retrospectivo e prospectivo da justiça restaurativa no Brasil, como também apontou desdobramentos da abordagem expandida de justiça restaurativa e ações para subsidiar a institucionalização e implementação de forma crítica e coerente, para que possamos, a médio e longo prazo, construir outros lugares, ou seja, restaurotopias.pt_BR
