Abstract

This dissertation verifies and comcants the legal protection granted to the worker's food credit when the debtor is a businessman or business company that has had his application for bankruptcy/judicial recovery granted, taking into account, especially, the legislation on the subject – Law 14.112/2020. It seeks to understand the effects of the judicial/bankruptcy recovery of one of the jointly and several/subsidiary debtor companies on the assets of the other and its partners. Through the analysis of legislation and jurisprudence seeks to know the legal procedure and the limits of material competence of the judicial bodies. It aims to verify whether the recent legislative changes culminated in an increase or decrease in the protection of labor food credit and whether the procedure was accelerated or slow. It uses the method of deductive approach, starting from the general and abstract prediction of the Federal Constitution, wage protection, through the conformation with infraconstitutional legislation, especially the food legislation.
