Demandas emergentes nas varas de família da comarca de Ponta Grossa/Pr considerando os novos arranjos familiares e as transformações contemporâneas

Abstract

O presente Trabalho de Conclusão de Curso tem como intuito analisar as demandas expostas nas Varas de Família da Comarca de Ponta Grossa - PR, a partir do Estudo Social determinado pelos juízes nos processos de ações de família do Sistema Projudi. O objetivo geral da pesquisa foi compreender as demandas apresentadas pelas famílias atendidas nas Varas de Família de Ponta Grossa – PR considerando as transformações nos arranjos familiares e sua expressão contemporânea, e os objetivos específicos trataram de contextualizar historicamente as transformações dos arranjos familiares em relação à realidade brasileira, refletir sobre a concepção de família de acordo com a literatura e as legislações vigentes no Brasil, bem como identificar os conflitos vivenciados pelas diferentes famílias atendidas nas Varas de Família da Comarca de Ponta Grossa - PR, considerando os diferentes arranjos familiares. A pesquisa foi realizada no ano de 2022, porém, os processos analisados correspondem ao período de 01 de janeiro a 31 de março de 2021.Teve como universo de pesquisa o Núcleo de Apoio Especializado (NAE), Varas de Família de Ponta Grossa – PR, no qual a prestação jurisdicional se dá principalmente com demandas vinculadas à infância e adolescência. Para alcance de tais objetivos, foi utilizada como metodologia a pesquisa quali-quantitativa de natureza exploratória e descritiva, pesquisa bibliográfica e documental, assim como as técnicas de observação sistemática e, por fim, frente às informações levantadas, a análise de conteúdo. Os resultados da pesquisa foram organizados em três capítulos, sendo o primeiro: compreendendo a família e seus arranjos na sociedade brasileira, o segundo: da compreensão dos direitos de família a partir dos ordenamentos jurídicos, e o terceiro: das demandas nas Varas de Família sob a ótica do Serviço Social.

This Course Completion Work aims to analyze the demands exposed in the Family Courts of the District of Ponta Grossa - PR, from the Social Study determined by the judges in the processes of family actions of the Projudi System. The general objective of the research was to understand the demands presented by the families served in the Family Courts of Ponta Grossa - PR, considering the transformations in family arrangements and their contemporary expression, and the specific objectives dealt with historically contextualizing the transformations of family arrangements in relation to reality Brazilian, to reflect on the conception of family according to the literature and legislation in force in Brazil, as well as to identify the conflicts experienced by the different families assisted in the Family Courts of the District of Ponta Grossa - PR, considering the different family arrangements. The research was carried out in the year 2022, however, the processes analyzed correspond to the period from January 1 to March 31, 2021. The research universe was the Specialized Support Center (NAE), Family Courts of Ponta Grossa - PR, in which the jurisdictional provision is mainly with demands linked to childhood and adolescence. In order to achieve these objectives, qualitative and quantitative research of an exploratory and descriptive nature, bibliographical and documentary research, as well as systematic observation techniques and, finally, based on the information collected, content analysis were used. The research results were organized into three chapters, the first being: understanding the family and its arrangements in Brazilian society, the second: the understanding of family rights from the legal systems, and the third: demands in the Family Courts under the perspective of Social Work.
